GENERAL AND PRELIMINARY PROVISIONS
The following Terms and Conditions of Use have been prepared by FRARI S.r.l., legal address in via Crosariole, 6 – 35010 Trebaseleghe (PD), P.IVA n.04393310281 (hereafter referred to FRARI) in order to regulate how to use the website www.fraridesign.com (hereafter referred to Website) for every user having access to the website (USER) and terms and conditions applied to website’s users.
For the purposes set out in this document, the term “use” is referred to every operation made by the USER starting in the moment he/she access to the website regardless of the kind of tool (PC, tablet or smartphone), connection (private, of third parties, public or Wi-Fi) and place the user make the access.
The following Terms and Conditions of Use for the Website www.fraridesign.com (hereafter “General Terms of Use”) could be modified or enriched by FRARI. Conditions applied will be the ones in force when the User accessed to the Website.

1 – ACCEPTANCE
The website is owned by FRARI S.r.l.. Accessing to the website and using its services the USER accepts unconditionally the following Terms and Conditions of Use. In case of not acceptance or reservation about, the USER has to refrain from the use of the Website.

2 – FEATURES AND FUNCTIONALITIES OF THE WEBSITE
The website is designed for information and trade purposes. In particular, the website allows the USER to get in touch with products and services provided by FRARI and to buy them according to arrangements and procedures envisaged. Online trade services offered in the website are subject to the Conditions of Sale.
The functionalities list is provided only as a guide. FRARI has the right to add or remove functionalities, temporarily or permanently, without notice and without the acceptance of the USER.

3 – TERMS OF USE FOR THE WEBSITE
The use of the website is allowed for private purpose only; the use of the website is consequently prohibited for commercial purposes. The website can be used by adults or by people less than eighteen authorized by the parent or his guardian. In any case, FRARI invites the parent or the guardian to monitor the use of the website of the minor. To get access to some services of the website the USER could be required to create an account with personal data necessary to his/her identification. In this case, the USER undertakes to provide complete and correct data concerning his/her identity and not to provide third parties data.
If the USER fails in his/her commitment, FRARI – without prejudice to the following art. 4 – will promptly suspend or remove the Account. All personal data provided by the User with this purpose will be managed according to the following art. 9.

4 – BEHAVIOR ON THE WEBSITE
he USER can not create any links to the website without the prior written consent of FRARI. The USER can not collect or gather personal data of the website users – by any means – and can not extract or record data or contents – for purposes other than the website navigation – in particular rights concerning image, intellectual property or privacy respect.
The USER can not upload or hand out – through the website – contents which can be considered illegal, obscene, defamatory, which constitutes a crime or can induce to crime or can affect the image and name of FRARI.
FRARI can delete in any time any profile, contents or information on the USER and/or forbid the use of the website. In these exceptional circumstances, FRARI can inform the competent authority and can take action to safeguard its or third parties’ rights.

5 – DOCUMENTS AND INFORMATION SENT THROUGH THE WEBSITE
FRARI will not accept any materials sent through the website other than documents expressly required. FRARI reserves the right to use freely – even for promotional purposes – documents or contents received through the website with no obligations to the USER who sent these contents.
Regardless of the contents above, FRARI has every right to delete every profile, content, information on the website even for technical reasons. Every change or cancellation can be made with no notice or previous communication.

6 – COLLATERALS
Except as provided by the Terms of Sale, materials and contents reported in the website are provided as they look and with no collaterals express or implied. FRARI do not guarantee the website and its contents fit with the user expectations in terms of service continuity or the absence or errors.
Some products can be reported through their close-proximity to images or graphic illlustrations whose purpose is just to recreate a scenario.

7 – INDUSTRIAL AND INTELLECTUAL PROPERTY
FRARI is the only owner of the website contents and related rights such as texts, documents, logos, images, layout, know-how and products; some of these contents could be protected by copyright, marks, patents or other rights on industrial and intellectual property recognized by Italian and International law. No contents of the website can be considered as licensed from FRARI or as object of rights for user or third parties.
The possibility to access to the website and its contents, agreed by FRARI only for the purposes reported in this document, do not give the user any rights on the website contents for personal or commercial purposes.
Users are authorized to download, view or print the website contents only for personal use in ways that are not to be done to damage industrial or intellectual rights of FRARI or third parties. In any case, website contents can not be used for different purposes such as their modification, reproduction or transmission with out the previous written consent of FRARI.

The USER gets access to the website autonomously and at his own risk. FRARI accepts no responsibility with regard to any pretention or damages linked to the use of the website or information contained, contents downloaded by the website included possible virus, malware or other tricky contents.
FRARI can stop or suspend the access to the website and all related services at any time and for any reasons with no responsibilities linked to this suspension or interruption.
FRARI is not responsible for contents of any other website available via a link in the website. These links – where included – aim to give the user more complete information.

9 – PERSONAL DATA PROTECTION
Data gathered through the website are managed by FRARI. All information concerning personal data sent by users through digital channels will be managed in accordance with the applicable law and the Information about processing of Personal data provided by FRARI. The USER can read the Policy about Personal data protection of FRARI (Privacy Policy) in the specific section on the website.

10 – ADDITIONAL ISSUES
Without prejudice to the Terms of Sale, the Privacy Policy and the Cookie Policy, these Terms and Conditions of Use represent the entire agreement between FRARI and the User concerning the use of the Website. Any other terms and conditions applied by FRARI to the website users would be considered as additional to these ones.
FRARI invites the website users to consult periodically the following Terms and Conditions and other sections of the website such as the Privacy Policy, the Cookie Policy and the Terms of Sale in order to verify the presence of any new changes or updates.

11 – APPLICABLE LAW AND COMPETENT COURT
The website, as currently set in terms of layout and contents, has been designed for users located in Italy and FRARI does not guarantee its contents are in accordance with laws applied out of Italy.
Any dispute concerning the website, its use and its contents will be entirely ruled in accordance with Italian law and the competent court will be the one expected by the Italian law when the contract have been concluded.
